Customer Agreement – Standard Terms of  Business – Initial Disclosure Document

Accepting our Terms of Business

By asking us to quote for, arrange or handle your insurances, you are providing your informed agreement to these Terms of Business. We draw your particular attention to the sections “Protecting your information”, “Credit Checks” and “Protecting your money”. For your own benefit and protection you should read these terms carefully.

Your duty of disclosure

Your insurance is based upon the information provided to the insurance company. You must ensure that all relevant information is complete and accurate throughout the period of cover and when you renew your insurance. It is important to answer all questions accurately and not to withhold any information which may assist us in providing you with appropriate advice and cover. You must take reasonable care not to make a misrepresentation to insurers.

How to cancel

You may have a statutory right to cancel some policies with❑in a short period of time – Please refer to your policy summary or your policy document for full details. If you cancel within a statutory period you will receive a pro rata refund of premium from the insurer less an amount to reflect our admin costs to arrange and then cancel the insurance. If you wish to cancel outside this period you may not receive a pro rata refund of premium. In some policies such as travel or liability there may be no entitlement to premium refunds. Your policy document will provide full details of cancellation charges. Where there is a refund, we may also retain an amount that reflects our admin costs in arranging and cancelling the insurance. A claim under any policy normally cancels any right to premium refunds.

Claims

Your policy document will provide details of the required procedures in the event of a claim. Generally, insurers require immediate notification of a claim or circumstances which might lead to a claim.

Customer Protection and Complaints

It is our intention to provide a high level of service at all times. For training and quality purposes, telephone calls may be recorded. However, if you have reason to make a complaint about our service you should contact the Compliance Manager at the address below. We will acknowledge your complaint by letter within 5 days followed by a written response within 20 working days. You may be entitled to refer the matter subsequently to the Financial Ombudsman Service. Further information is available at http://www.financial-ombudsman.org.uk.

How to claim

We are pleased to provide you with assistance in the event of a claim. Please refer to your policy summary or your policy document if you need to contact the insurer direct as contact details are provided.

Protecting your information

Where we process personal data we will comply with statutory data processing requirements as set out by the Data Protection Act 2018. We will process your personal data to allow us to provide you with our services as your insurance broker in quoting for, arranging and administering your insurances and any insurance premium finance. Your personal data will also be used to manage future communications between us. Where you have agreed, or in circumstances where to do so will be in our mutual interests, your personal data will be used to provide you with further information about our wider products and services. You can opt out from receiving such communications by e-mailing optout@kerrgroup.co.uk.Some or all of the information you supply to us in connection with your insurance proposal may be passed to insurance companies or other insurance intermediaries for underwriting and claims purposes. Protecting your money

Prior to your premium being forwarded to the insurer, and for your protection, we either hold your money as an agent of the insurer (in which case your insurance is treated as being paid for), or we hold it in a client bank account for you under a Non-Statutory Trust. We may extend credit to other customers from this account and we may need to transfer your money to another intermediary
for onward transmission to a scheme insurer in some cases. However your money will be protected at all times because of the requirements of the FCA rules. We also reserve the right to retain interest earned on this account. By accepting these Terms of Business you are giving your consent for us to operate in  this way.

Compensation arrangements

We are covered by the Financial Services Compensation Scheme. You may be entitled to compensation from this scheme if we cannot meet our obligations. This depends on the type of business and the circumstances of the claim. Insurance advising and arranging is covered for 90% of the claim, without any upper limit. For compulsory classes of insurance, insurance advising and arranging is covered for 100% of the claim, without any upper limit. Whose products do we offer?

We offer products from a range of insurers for almost all classes of general insurance transacted – other than the following. We offer products from a limited number of insurers for Travel, breakdown recovery, Self Build insurance, Motorhome insurance, and Legal Expenses insurance. We offer products from a single provider for GAP, claims preparation and car hire. Ask us for a list of these insurers.

Which service will we provide you with?

We will advise and make a recommendation for you after we have assessed your needs for personal and commercial insurances. We may ask some questions to narrow down the selection of products which we will provide details on. You will then need to make your own choice about how to proceed.

What standard administration charges do we make?

Mid Term Policy alteration <£25.00, New Policies <£50.00, Renewed Policies <£50.00, Evidence of No Claim Discount £10.00, Replacement Certificate £10.00, Non Commission Policies <15% of premium, Policy Cancellation 15% of the net insurer credit after repayment of our commission to the insurer, Dishonoured Cheques <£25.00, Low commission products <£50.00. Other non standard charges may be made from time to time, the amount and purpose will be advised to you at that time.

Premium Financing

We will normally accept payment by cheque, BACS, cash or credit card. You may be able to spread your payments through an insurer instalment scheme, insurer credit card scheme or by arranging premium finance from one of a panel of “third party” lenders. We will give you full information on your chosen payment option. Please note that in the event of a policy cancellation (including when enforced by the lender) or any default in the finance agreement – any shortfall in the funding arrangement incurred by a third party finance provider may be reclaimed back from ourselves by the lender and it will be your responsibility to make good any shortfall to us. Shortfalls can arise due to cancellation charges applied by insurers, defaults or late payments charges, or a claim under the policy which cancels entitlement to premium refund.

Credit Checks

We and other firms involved in arranging or quoting your insurance (insurers, other intermediaries or premium finance companies) may use a variety of sources including credit reference agencies and other organisations. The information is used to help tailor a price, to ascertain the most appropriate payment options for you and to help prevent fraud. Any credit reference search will appear on your credit report whether or not your application proceeds.
